AliExpress "Free Returns", "Free Shipping" and "Fast Delivery" Terms and Conditions
Please read these terms and conditions carefully! By using relevant services under "Free Returns", "Free Shipping" and "Fast Delivery" on AliExpress iPhone and Android Apps and the mobile site of AliExpress ("AliExpress Platform"), you as a registered user of AliExpress Platform who satisfy certain requirements as determined by AliExpress at its sole discretion ("You" or "Buyer") will be deemed to have consented to these terms and conditions ("Terms"). You acknowledge and agree that you have independently evaluated the desirability of participating in and are not relying on any representation, guarantee, or statement other than as expressly set forth in these Terms; and hereby represent and warrant that you are lawfully able to enter into these terms, that you have reached the age of majority at your place of origin and residence, and that you are and will remain in compliance with these Terms. Please pay attention to provisions that exclude or limit your rights, terms of governing law and jurisdiction, and or other terms which may appear in bold and/or underlined letters.
In relation to offers concluded on AliExpress Platform for selected merchandise with the program icons (such selected merchandise is referred to as "Participating Product(s) ") including "Free returns", "Free Shipping" and "Fast Delivery", the seller of such Participant Products ("Participating Seller(s) ") has agreed to provide all or part of the "Free Returns", "Free Shipping" and "Fast Delivery" to the Buyer in accordance with these Terms. Please note that the content of the related "Free Returns", "Free Shipping" and "Fast Delivery" shall be based on the specific information displayed on the product detail page for each Participating Product and is totally depending on whether the seller participants or not in each order.
Section 1 Free Returns
Article 1 You shall be entitled to deliver the Participating Products to the free returns warehouse specified by the Participating Seller ("Free Returns Warehouse") free of charge ("Free Delivery Service"). The Buyer acknowledges that he or she will only be entitled to enjoy the Free Delivery Service once for each order containing Participating Product(s). Buyer that may not use the Free Delivery Service shall still be entitled to enjoy the Free Returns Service; however, Buyer that may not use the Free Returns Service are automatically excluded from the Free Delivery Service.
Article 2 With the Free Returns Service, a Buyer can apply for a return and refund of a Participating Product without cause within certain period, which shall be subject to the displays on the AliExpress order page. For an order placed with Participating Seller who is from Mainland China, Buyer can apply for a return and refund within 90 calendar days from the date when the order was placed by the Buyer on AliExpress Platform and paid successfully. For an order placed with Participating Seller who is from European Union, Buyer can apply for a return and refund within 15 calendar days from, as the case may be, 1) the date when the Buyer confirms receipt of the Participating Product, or 2) the date when the system automatically confirms receipt of the Participating Product after confirming that the Product has been duly delivered. For order placed with Participating Seller who is from in Federative Republic of Brazil, Buyer can apply for a return and refund within 7 calendar days from, as the case may be, 1) the date when the Buyer confirms receipt of the Participating Product, or 2) the date when the system automatically confirms receipt of the Participating Product after confirming that the Product has been duly delivered. Buyer can apply for such return and refund through "Return/refunds" on the AliExpress order page if the Participating Product meets the standards of intactness as stipulated in Article 4 After the Participating Product has been shipped to Free Returns Warehouse and verified by the Free Returns Warehouse to meet the standards of intactness prescribed in Article 4, Buyer may receive the refund from the corresponding Participating Seller in accordance with these Terms. If the Participating Product returned by the Buyer does not meet the standards of intactness, the refund process would be affected by this. Where the Buyer applies for the Free Returns Service as mentioned above and such Buyer is not able to enjoy the Free Delivery Service or chooses not to use the Free Delivery Service, the Buyer shall arrange for shipment by himself or herself and fill in the shipment tracking number at the "Return/refunds" page on AliExpress. The Buyer acknowledges that if such Buyer arranges for shipment by himself or herself as aforementioned, the risk of loss passes from the Buyer to the Free Returns Warehouse at the time of receipt of products by the Free Returns Warehouse. With the Free Returns Service, if the Free Returns Warehouse does not receive the returned Participating Product within 8 calendar days after Buyer submitted shipment tracking number or the Free Returns Warehouse does not receive the corresponding Participating Product, AliExpress shall be entitled to determine liability upon arbitration according to the AliExpress rules and protocols.
Article 3 With the Free Delivery Service, a Buyer can ship the Participating Products through the delivery service provider specified by the Participating Seller after such Buyer has "Return/refunds" according to Article 2. Where the Buyer uses the Free Delivery Service, the shipping tracking number will be automatically uploaded to the system. The Buyer acknowledges that if such Buyer uses the Free Delivery Service, the risk of loss passes from the Buyer to the delivery service provider specified by the Participating Seller at the time of receipt of products by the delivery service provider specified by the Participating Seller. With the Free Delivery Service, if the Free Returns Warehouse does not receive the corresponding Participating Product, AliExpress shall be entitled to determine liability according to the AliExpress rules and protocols.
Article 4 In order to enjoy the Free Returns Service, the Participating Product being returned by the Buyer shall meet the standards of intactness as specified below:
1. The Participating Product has remained its original quality and functioning. The Buyer shall ensure that the returned Participating Product and all accompanying accessories (such as tags, manuals, and warranty cards) are complete and remained their original quality and functioning, and show no signs of damage or contamination, the anti-counterfeiting mark has not been scraped, any activation/authorization has not been made, and there are no traces of usage on the appearance or other traces which indicate unreasonable personal use.
2. The Buyer’s opening of package for inspection or testing to verify the Participating Product’s quality and functioning is reasonable and does not affect the Participating Product’s intactness. Where any use of a Participating Product by the Buyer results in significant devaluation, the returned Participating Product shall be deemed defective and not in line with the standard of intactness.
3. Buyer understands that the packaging is an integral part of the Participating Product and consist part of the offer from the Participating Seller; and any use of and/or defect(s) to the packaging caused by the Buyer may result in devaluation of the Participating Product. Therefore, the Buyer shall ensure the packaging of the returned Participating Product is full and intact. In terms of packaging with special value, design, material and/or functions, Buyer and/or his or her courier shall ensure all handling is carried out in accordance with the requirement about product protection and packaging specified by the Participating Seller upon fulfillment of the transaction.
(1) Standards of intactness for regular package:
There is no missing part in the original package, and the form, shape and structure of the package is complete. However, unavoidable changes in form, shape and/or structure resulting from transportation and unpacking, including, but not limited to, minor to moderate deformation, stain and/or partial damage, shall not be considered to affect the intactness of the regular package.
(2) Standards of intactness of special package:
If the package contains value added parts, such as an anti-counterfeiting feature, special designs or functions, or markers or other indicators representing commemorative value, the Participating Seller may make requirements of special protection of the package to the Buyer. Where there are reasonable package protection requirements prominently and explicitly specified by the Participating Seller, the Buyer shall protect the package proactively and carefully. If the damage of such package results in devaluation and/or loss of functions, the Product will be devalued and thus deemed as defective and not in line with the standard of intactness.
However, where the Participating Seller makes requirement about protection of special packages but fails to do so in a prominent and explicit way, the standards of intactness for regular package shall apply.
Where the package does not contain any special value added parts as mentioned above, the standards of intactness for regular package shall apply.
Article 5 Loss or damage of gift and loss of invoice shall not affect the return of Participating Product. However, for damage or loss of gift, a deduction from the refund shall be made based on the gift’s market price; for loss of invoice, the Buyer shall bear the corresponding tax.
Article 6 If a Buyer does not use the Free Delivery Service, the Buyer shall bear the cost of returning the Participating Product to Free Returns Warehouse ("Cost of Return") when applying for the Free Returns Service. In addition to the Cost of Return, whether or not the Buyer uses the Free Delivery Service, the Buyer shall bear the cost of shipping Participating Product by Participating Seller to him or her, if the Participating Product is subject to conditional free shipping and the Buyer’s partial return results in nonsatisfaction of the free shipping conditions, AliExpress shall deduct shipment costs borne by the Buyer on behalf of Participating Seller from the refund payable to the Buyer.
Where AliExpress determines, at its sole and absolute discretion, that the Buyer has abused its rights by repeatedly applying for the Free Returns Service and/or the Free Delivery Service (if applicable) or showing a high rate for orders applying for the Free Returns Service and/or the Free Delivery Service (if applicable), the Buyer shall bear all shipping costs, and AliExpress shall be entitled to deduct all shipping costs from the refund and may deny the same Buyer’s future eligibility of the Free Returns Service and/or the Free Delivery Service.
Article 7 Whether a product is a "Participating Product" with the Free Returns Service offer and/or the Free Delivery Service offer (if applicable) shall be determined by whether such product(s) bear a "Free Returns" icon, which may be determined and/or changed by AliExpress in its own discretion.
Section 2 Free Shipping
You agree and acknowledge that only if the amount of an order with one Participating Product or several Participating Products purchased by You reaches a threshold amount as stipulated on the page of AliExpress Platform, then You may not need to pay any shipping fee for this order ("Free Shipping"). However, not all products on AliExpress Platform are entitled to enjoy Free Shipping, please refer to the product detail page to check whether there is a label of "Free Shipping" or not (the specific format of the label may be changed from time to time) on each product and whether there is a shipping fee when You check out and pay for a specific order. Please note that the threshold amount required for Free Shipping may vary, which shall be subject to the one as stipulated on the product detail page.
This Terms shall not apply to all the countries, it shall be subject to specific information displayed on the country-specific pages of AliExpress Platform.
Section 3 Fast Delivery
Article 1 Coupon code for late delivery: Participating Product(s) with the icon of "Fast Delivery" are assured to arrive by the estimated delivery date. If the Participating product(s) does not arrive by the latest estimated delivery date (the order is referred to as "Delayed Order"), You are entitled to apply for a coupon code via the order details page. Once your application is approved, You will be issued the coupon code and notified by email. The value of this coupon code is shown on the order details page corresponding to your Delayed Order. You can check your coupon codes by visiting Account > Coupons. Any Delayed Order that has been cancelled is not qualified to apply for this coupon. One coupon is only applicable per order, including a single order with multiple Participating Products delivered in multiple packages. The coupon is valid for 60 calendar days from issue and only applicable to all non-virtual items on AliExpress, or otherwise the specific validity period shall be subject to the displays on the order details page, and which may be changed from time to time. It can be used on any order amount which is higher than the coupon code value. Only Participating Products marked with Fast Delivery qualify for this coupon code. The estimated delivery date for an order is indicated on the order details page with a time countdown. For any further questions regarding the delivery times, You can contact our Help Center. If your application for a coupon code is unsuccessful, you can re-apply as long as you meet the indicated application conditions. Please note that the compensation coupon codes are also subject to AliExpress Coupon Code Terms & Conditions. In the event that there is any conflict between the rules indicated herein and the AliExpress Coupon Code Terms & Conditions, the rules indicated herein shall take precedence.
Article 2 Refund if items arrive damaged: For the Participating Product with a "Fast Delivery" icon, a buyer can apply for a refund in whole or in part if such Participating Product within the order can be proved as damaged totally or in part upon arriving. The return amount will be determined in accordance with the status of the relevant item, for which, AliExpress has a sole discretion based on the evidencing materials provided by You subject to applicable rules on AliExpress Platform.
Article 3 Refund for packages lost in transit: For the Participating Product with a "Fast Delivery" icon, a Buyer is entitled to apply for a full refund for the relevant order if the package for such order is indicated as "lost in transit" (or displays other similar wording) on its tracking details page.
Article 4 Refund if not delivered after certain days: For the Participating Product with a "Fast Delivery" icon, a Buyer can apply for a refund for an order if the package is not delivered within certain calendar days ("Delivery Days") after shipment. The before mentioned Delivery Days may be vary, which shall be subject to the one as specified on the relevant product page on AliExpress Platform.
All these hereunder section 3 are collectively referred to as "fast delivery".
Section 4 General terms
Article 1 Exclusion of Liability
Under any of following circumstances, the Participating Seller and AliExpress platform shall not be obliged in any way to offer all or any of the "Free Returns", "Free Shipping" and "Fast Delivery" (if applicable) and/or provide any refund (unless otherwise required by applicable laws or the AliExpress rules):
(1) Fraud on the part of the Buyer;
(2) Improper conduct of the Buyer in violation of the instructions;
(3) Natural consumption or wear and tear of the product;
(4) Product recall;
(5) External causes during transportation or storage; and
(6) Defects unable to be detected with the technology in domestic market at the time of manufacture.
Article 2 Exemption
The Participating Seller and AliExpress platform shall not be responsible for losses and costs of the following products (unless otherwise required by applicable laws or AliExpress rules), and the Participating Seller and AliExpress platform shall not be under any obligation to provide Free Delivery Service, refund or a coupon code for the following products:
(1) Quality, late delivery, lost or damage of products or any other related issues of a product have been acknowledged and accepted by the Buyer;
(2) Products are sold after the Participating Seller has been suspended, closed down or bankrupted.
Article 3 Force Majeure
Under no circumstances shall AliExpress and/or the Participating Seller be held liable to the Buyer for (i) all or any part of the rights under the "Free Returns", "Free Shipping" and "Fast Delivery" herein, including the free delivery service, any refund or Delivery Days guarantee; or (ii) any other rights under this Terms, due to or resulting directly or indirectly from the occurrence or continuance of any following events, even though such event may has existed at the time when the order was paid or the Products was shipped:
(1) Natural disasters including, but not limited to, acts of God, earthquakes, lightning strokes, fires, explosions, storms, floods, typhoons and other severe or abnormal weather;
(2) Internet failures, computer, telecommunications or any other equipment failures, electrical power failures or cyber event;
(3) War, explosions, military actions, terrorism, terrorist acts;
(4) Official or unofficial industrial action, industrial sabotage, industrial dispute, strikes or lockouts, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, accidents, theft, robbery, casualties, Sanctions, embargo or other disruption or interference with trade;
(5) Acts of government (including delays or disruption due to insufficient capacity of customs under the situation of policy adjustment in delivery destination country), confiscation by relevant government authorities, orders of domestic or foreign courts or tribunals;
(6) Nuclear reaction, nuclear radiation, radioactive or any other form of contamination;
(7) Non-performance of third parties or any suspension or disruption of transportation or business operation (including but not limited to delays or disruption of the resumption of work or operation ordered by any government agency) in the event of a national or regional spread of epidemic or pandemic;
(8) Any event, circumstance or cause whatsoever beyond its reasonable control or cannot be avoided by the exercise of reasonable endeavors (a "Force Majeure Event").
Article 4 Severability.
If any term of these T&Cs is to any extent illegal, otherwise invalid, or incapable of being enforced, such term shall be excluded to the extent of such invalidity or unenforceability; all other terms hereof shall remain in full force and effect; and, to the extent permitted and possible, the invalid or unenforceable term shall be deemed replaced by a term that is valid and enforceable and that comes closest to expressing the intention of such invalid or unenforceable term.
Article 5 Conflict of terms and conditions.
In the event that any of the terms under these Terms conflict with rules and/or any such related information displayed elsewhere on AliExpress Platform, the terms under these Terms shall prevail.
Article 6 Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE PARTICIPATING SELLER AND ALIEXPRESS PLATFORM BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF USE, DATA, BUSINESS OR PROFITS) ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED UPON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, AND WHETHER OR NOT PROMOTER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE.
Article 7 Amendment of the Terms
AliExpress is entitled to amend these Terms at any time by posting the relevant amended and restated Terms on AliExpress Platform, without further notice to Buyers. By continuing to purchase Participating Product(s), users and Buyers agree that the amended and restated Terms will apply and are deemed to have accepted the amended and restated Terms. Please also pay attention to the display updates on the relevant pages.
Article 8 Governing Law and Dispute Resolution
These Terms are governed, interpreted and enforced by the laws of Hong Kong, without regard to its conflict of laws principles. Any and all legal actions, claims or proceedings arising out of, or in connection with these Terms must be brought in a court of competent jurisdiction in Hong Kong.
Article 9 Applicable Countries
These Terms shall not apply to all the countries, it shall be subject to information displayed on the country-specific pages of AliExpress Platform.
Article 10 Languages
These Terms are published in English and multiple languages (if any). In case of any discrepancy between different language versions, the English one shall prevail.
