This “알.친.소 Group Deal” Promotional Program terms and conditions (the “T&Cs”) contain the terms and conditions that govern your participation in the “알.친.소 Group Deal” promotional program (the “Program”).  “AliExpress” or “our” means Alibaba.com Singapore E-Commerce Private Limited, a company incorporated under the laws of Singapore and having its registered address at 51 Bras Basah Road, #01-21 Lazada One, Singapore and ALIEXPRESS KOREA HOLDING (SINGAPORE) PTE. LTD., a company incorporated under the laws of Singapore and having its registered address at 51 Bras Basah Road, #01-21 Lazada One, Singapore. “You”, “your” or “Participant” means any Eligible Participant (as defined below) who has joined  the Purchase Group (as defined below). Each of AliExpress and Participant is referred to as a “Party” and collectively as “Parties”.

본 "알.친.소 공동구매" 프로모션 프로그램 이용약관(이하 "본 약관")은 "알.친.소 공동구매" 프로모션 프로그램(이하 "프로그램")을 참여하는 데 있어 귀하의 참여를 규율하는 약관을 포함하고 있습니다. "AliExpress" 또는 "당사"는 싱가포르 법률에 따라 설립된 회사로서, 싱가포르 51 Bras Basah Road, #01-21 Lazada One에 등록된 주소를 가진 Alibaba.com Singapore E-Commerce Private Limited 및 싱가포르 법률에 따라 설립된 회사로서, 싱가포르 51 Bras Basah Road, #01-21 Lazada One에 등록된 주소를 가진 ALIEXPRESS KOREA HOLDING (SINGAPORE) PTE. LTD.를 의미합니다.  "귀하", "당신" 또는 "참가자"는 공동구매 그룹(아래에 정의된 바를 따름)에 참여한 자격을 갖춘참가자(아래에 정의된 바를 따름)를 의미합니다. AliExpress와 참가자 각각을 "당사자"라고 하며, 함께 "당사자들"이라고 합니다.

 

If you join the 알.친.소 Purchase Group (as defined below) on the AliExpress Platform (as defined below), you agree to be bound by these T&Cs. You acknowledge and agree that you have independently evaluated the desirability of participating in the Program and are not relying on any representation, guarantee, or statement other than as expressly set forth herein these T&Cs; and hereby represent and warrant that you are lawfully able to enter into contracts (e.g. you are not a minor) and that you are and will remain in compliance with these T&Cs. In addition, if these T&Cs are being agreed to by a company or other entity, then the person agreeing to these T&Cs on behalf of that company or entity hereby represents and warrants that he or she is authorized and lawfully able to bind that company or entity to these T&Cs.

귀하가 AliExpress 플랫폼(아래에 정의된 바를 따름)에서 공동구매 그룹(아래에 정의된 바를 따름)에 참여하는 경우, 귀하는 이 약관에 구속될 것에 동의합니다. 귀하는 본 프로그램에 참여하고자 하는 의사를 독립적으로 판단했으며, 본 약관에 명시적으로 제공된 바 외에 어떠한 진술, 보증 또는 성명에도 의존하지 않음을 인정하고 동의합니다. 그리고 귀하는 법적으로 계약을 체결할 수 있는 권리가 있음(예: 미성년자가 아님)을 보증하며, 본 약관을 준수할 것임을 이로써 표시하고 보증합니다. 또한, 회사 또는 기타 법인이 본 약관을 동의하는 경우, 해당 회사 또는 법인을 대신하여 본 약관에 동의하는 자는 해당 회사 또는 법인이 본 약관에 법적으로 구속되도록 할 수 있는 권한이 있음을 표시하고 보증합니다.

 

AliExpress reserves the right to update, modify and amend the terms in connection with the Program published on the AliExpress Platform from time to time by publishing the revised terms. AliExpress shall notify South Korea consumers at least 7 days in advance of any changes, unless exceptional circumstances apply. The revised terms shall take effect from the relevant date, and become a part of these T&Cs. Your continued participation in the Program after the effective date of the revised terms shall be deemed as your acceptance of the same.

AliExpress는 AliExpress 플랫폼에서 시간이 지남에 따라 프로그램과 관련된 본 약관을 업데이트, 수정 및 변경할 권리를 보유합니다. AliExpress는 예외적인 상황이 적용되지 않는 한, 변경 사항이 있을 경우 최소한 7일 전에 대한민국 소비자에게 통지할 것입니다. 개정된 약관은 관련 날짜부터 효력을 발생하며, 이 약관의 일부가 됩니다. 개정된 약관의 효력 발생일 이후 프로그램에 계속 참여함으로써, 귀하는 개정된 약관을 수락하는 것으로 간주됩니다.



1.

“알.친.소 Group Deal” Promotional Program

"알.친.소 공동구매" 프로모션 프로그램

 

1.1.

This Program is available only in APP.

프로그램은 APP에서만 사용 가능합니다. 

 

1.2.

Unless otherwise disqualified pursuant to Clause 1.5, an AliExpress registered user in South Korea whose selects South Korea as the shipping country shall be eligible to participate in the Program(the “Eligible Participant”). “알.친.소 Group Deal” is a form of purchase in which a user invites the specific number of users required by AliExpress(as defined below) to create a group (“알.친.소 Purchase Group”) by the point of time set by AliExpress to purchase a product specifically displayed by AliExpress for this Program (“Promotion Product”) at a discounted price for a limited period of time set by AliExpress on AliExpress e-commerce platform (the “AliExpress Platform”) during the Promotional Period (as defined below) and the 알.친.소 Purchase Group Host (as defined below) is rewarded with reward set by AliExpress (“알.친.소 Purchase Group Host Reward”). AliExpress does not guarantee that every 알.친.소 Group Deal participated by the Eligible Participant will be successful resulting in purchase and delivery of the Promotion Product.

제1.5조에 따라 자격이 박탈되지 않는 한, 배송 국가로 대한민국을 선택한 대한민국 내의 AliExpress 등록 회원은 프로그램에참여할 자격이 있습니다("자격을 갖춘 참가자"). “알.친.소 공동구매”는 회원이 프로모션 기간 (아래에 정의된 바를 따름)동안 AliExpress 전자상거래 플랫폼("AliExpress 플랫폼")에서 본 프로그램을 위하여 AliExpress가 특정하여 표시하는 상품(“프로모션 상품”)을 AliExpress가 지정한 제한된 시간 동안 할인된 가격으로 구매하기 위한 그룹(“알.친.소 공동구매그룹”)을 개설하여 AliExpress 가 지정한 특정 인원 수의 회원(아래에 정의된 바를 따름)들을 AliExpress가 정한 시간까지 초대하면 알.친.소 공동구매 방장(아래에 정의된 바에 따름)에게 AliExpress가 지정한 리워드(“알.친.소 공동구매 방장 리워드”)를 지급하는 형태의 구매 형식입니다. AliExpress는 자격을 갖춘 참가자가 참여한 모든 알.친.소 공동구매가 프로모션 상품의 구매 및 배송을 이어지는 등 성공적일 것을 보장하지 않습니다. 

 

1.3.

The user who creates a Purchase Group becomes the host of such 알.친.소 Purchase Group (“알.친.소 Purchase Group Host”). 알.친.소Purchase Group Host should be an Eligible Participant and a user who is not a new user (as defined below) (“Existing User”). 알.친.소 Purchase Group is available to open at time set by AliExpress. A URL link and ID of 알.친.소 Purchase Group are created upon successful payment of the Promotion Product by알.친.소 Purchase Group Host. Other users may participate in 알.친.소 Purchase Group via above URL link or by searching 알.친.소 Purchase Group’s ID and may purchase a Promotion Product at a discounted price for a limited period of time set by AliExpress. As for 3-person Group Purchase, two of remaining Eligible Participants other than 알.친.소 Group Purchase Host must be new users. A new user refers to a user without any previous purchase history on AliExpress after membership registration or an existing user whose last purchase date is more than 1 year ago; provided that the user will not be considered as a new user if a reason for having no previous purchase history is due to user's cancellation of the purchase.

알.친.소 Group Deal is considered successful upon completion of payment for the Promotion Product by all Eligible Participants of 알.친.소 Purchase Group (in this case, “Successful 알.친.소 Group Deal”). A seller shall start the delivery of the Promotion Product only when Successful 알.친.소 Group Deal is confirmed. The result of redeeming 알.친.소 Purchase Group Host Reward is available in 알.친.소 Group Purchase Record after 24 hours from the point of time of Successful 알.친.소 Group Deal. 알.친.소 Group Deal Purchase Record can be found on 알.친.소 Group Purchase Page which can be searched by putting the word ‘알친소’ on APP Main search box. 알.친.소, Purchase Group Host Reward is given as Naverpay Point Code("Code") through AliExpress APP. The Code must be claimed before the claim valid period stipulated on Clause 1.7.

알.친.소 공동구매 그룹을 개설한 회원은 해당 알.친.소 공동구매 그룹의 방장(“알.친.소 공동구매 방장”)이 됩니다. 알.친.소 공동구매 방장은 자격을 갖춘 참가자이자 신규 회원(아래에 정의하는 바를 따름)이 아닌 회원(“기존 회원”)이어야 합니다. 알.친.소 공동구매 그룹은 매일 AliExpress가 지정한 시간에 개설 가능합니다. 알.친.소 공동구매 방장이 프로모션 상품에 대한 결제를 성공적으로 완료 시 알.친.소 공동구매 그룹에 대한 URL 링크 및 ID가 생성됩니다. 다른 회원들은 위 URL 링크를 통하거나 알.친.소 공동구매 그룹의 ID를 검색함으로써 알.친.소 공동구매 그룹에 참여하여 AliExpress가 정한 제한된 시간 동안 프로모션 상품을 할인된 가격으로 구입할 수 있습니다. 3명 공동구매의 참여 인원 중 알.친.소 공동구매 방장을 제외한 두 명은 반드시 자격을 갖춘 참가자이자 신규 회원이어야 합니다. 신규 회원은 회원 가입 후 AliExpress에서 구매 이력이 없는 회원이거나 마지막 구매일로부터 1년이 경과한 회원이어야 합니다. (단, 기존 주문 건을 회원이 주문 취소함으로써 구매이력이 존재하지 않는 경우 신규 회원으로 보지 아니함)

알.친.소 공동구매는 알.친.소 공동구매 그룹의 모든 자격 있는 참가자들이 AliExpress가 정한 시간까지 프로모션 상품에 대한 결제를 완료한 때에 성공한 것으로 간주됩니다(이 경우, “알.친.소 공동구매의 성공”). 판매자는 알.친.소 공동구매의 성공이 확인될 때에 한하여 프로모션 상품의 배송을 시작합니다. 알.친.소 공동구매 방장 리워드 지급 여부에 대한 결과는 알.친.소 공동구매의 성공 이후 24시간 후 알.친.소 공동구매 참여 기록에서 확인 가능합니다. 알.친.소 공동구매 참여 기록은 APP 메인 검색란 에서 ‘알친소’라는 단어를 검색하여 나오는 알.친.소 공동구매 페이지에서 확인 가능합니다. 알.친.소 공동구매 방장 리워드는 AliExpress App에서 네이버페이 포인트 코드("코드")로 지급합니다. 해당 코드는 1.7조에 기재된 수령 유효기간 전에 수령하여야 합니다. 

 

1.4.

The Program shall be effective from 9 April 2025 00:00:00 (KST) until terminated or discontinued at the discretion of AliExpress with or without prior written notice (the “Promotional Period”). For avoidance of doubt, AliExpress reserves its absolute right to operate this Program from time to time intermittently on ad-hoc base during Promotional Period at its discretion.  

본 프로그램은 2025년 4월 9일 00:00:00(한국시간)부터 AliExpress의 재량에 따라 사전 서면 통지 여부와 상관없이 종료되거나 중단될 때까지 유효합니다("프로모션 기간"). AliExpress는 그 재량에 따라 프로모션 기간 동안 본 프로그램을 수시로 간헐적이고 임시적으로 운영할 수 있는 절대적인 권리를 보유합니다.

 

1.5.

An AliExpress registered user will be disqualified from participating in the Program or participation in the Group Deal will be cancelled and revoked, in case of such user who has violated, or is suspected to have violated the rules (including but not limited to fraud and abusive actions in respect of his/her purchase, providing false evidence, conducting false transactions, using cheats or plug-ins or other abnormal means, money laundering, malicious cashing out, brushing reputation, cheating, multiple accounts etc.), will not be eligible to participate in the Program and in which case AliExpress reserves the right to cancel or modify the promotion, cancel the purchase orders and 알.친.소Purchase Group Host Reward, restrict opening 알.친.소 Purchase Group, and take any legal actions against such user.

AliExpress 등록 회원이 규칙을 위반했거나 위반한 것으로 의심되는 경우(구매와 관련된 사기 및 남용 행위, 허위 증거 제공, 허위 거래 수행, 치트(cheat)나 플러그인 또는 기타 비정상적인 수단 사용, 자금 세탁, 악의적인 현금화, 평판 훼손, 부정행위, 다중 계정 등을 포함하나 이에 국한되지 않음), 본 프로그램에 참여할 자격을 상실하며 공동구매에 대한 참여가 취소 및 철회됩니다. 이러한 경우 AliExpress는 프로모션을 취소하거나 수정하고, 주문 및 알.친.소 공동구매 방장 리워드를 취소하며, 알.친.소 공동구매 그룹 개설을 제한하며, 해당 회원에 대한 법적 조치를 취할 권리를 보유합니다.

 

1.6.

AliExpress has the sole and absolute discretion in, with reference to Clause 1 of the T&Cs, determining the eligibility of any Participant for the Program.  

AliExpress는 본 약관 제1조를 참조하여, 본 프로그램에 대한 참가자의 자격 여부를 결정할 단독적이고 절대적인 재량을 가집니다.

Naverpay Point Code Usage

네이버페이 포인트 코드 사용 방법

 

1) 

Claim Validation Period

The Code can be claimed by April 23th, 2025 23:59(KST).

2) 

Code Validation Period

The Code is valid for 60 days, starting the day after the user claims the code. Please note that this code cannot be extended or refunded, so user should make sure to use it within the validity period.

 

코드 유효기간

코드는 60일 간 유효하며, 해당 기간은 유저가 코드를 요청한 다음날부터 가산합니다. 본 코드는 유효기간의 연장 및 환불이 불가한 상품이므로 반드시 유효기간 이내에 사용하시기 바랍니다.

Redemption Method

The Code is available for claiming in 알.친.소 Group Purchase Record. 알.친.소 Group Deal Purchase Record can be found on 알.친.소 Group Purchase Page which can be searched by putting the word ‘알친소’ on APP Main search box.

Other Information

The supplier and issuer of this code is kt alpha Co., Ltd. The use of Naverpay Point Code is subject to the Naverpay Point FAQ(available at: https://help.admin.pay.naver.com/faq/content.help?faqId=1147), and any other applicable rules, policies and/or terms and conditions of Naverpay Point.

기타 사항

본 모바일 상품권 공급자 및 발행사업자는 주식회사 케이티알파입니다. 네이버페이 포인트 코드 사용은 네이버페이 포인트 코드 FAQ(확인 가능: https://help.admin.pay.naver.com/faq/content.help?faqId=1147) 및 기타 관련 규칙, 정책 및/또는 네이버페이 포인트 약관에 따릅니다.

 

1.8.

Notwithstanding the preceding provision, a Participant who has completed 알.친.소 Successful Group Deal before any change, modification, limitation or suspension to the Program has the right to services under the T&Cs. 

상술한 조항에도 불구하고, 본 프로그램의 변경, 수정, 제한 또는 중단 이전에 알.친.소 공동구매의 성공을 완료한 참가자는본 약관에 따른 서비스를 받을 권리가 있습니다.

Details of the Program

2.1.

The number of 알.친.소 Purchase Group 알.친.소 Purchase Group Host can open in a day and the total number of 알.친.소 Purchase Group AliExpress allows to be opened in a day are limited. The number of 알.친.소 Purchase Group a user can open is subject to changes from time to time at AliExpress' discretion and such change will be announced in the latest version of FAQ. Regardless of Participant’s creation of 알.친.소 Purchase Group or cancellation of purchase order after Successful 알.친.소 Group Deal, such purchase via 알.친.소Group Deal will be counted as valid participation and deducted from limited number of chances to open 알.친.소 Purchase Group.

자격을 갖춘 참가자이자 기존 회원이 하루에 최대 개설할 수 있는 알.친.소 공동구매 그룹의 수량 및 본 프로그램에서AliExpress가 허용하는 하루에 개설 가능한 알.친.소 공동구매 그룹의 총 수량에는 제한이 있습니다. 회원이 하루에 개설 가능한 알.친.소 공동구매 그룹수는 AliExpress의 재량에 따라 수시로 변경될 수 있으며 이는 최신 버전의 FAQ를 통하여 공지됩니다. 참가자의 알.친.소 공동구매 그룹 시작 또는 알.친.소 공동구매 성공 이후 구매 주문이 취소되더라도 이와 상관없이 알.친.소 공동구매를 통한 위 구매는 유효한 참여로 간주되며 알.친.소 공동구매에 참여하거나 알.친.소 공동구매 그룹을 개설할 수있는 제한된 횟수에서 차감됩니다.

 

2.2

알.친.소 Purchase Group Host Reward is subject to changes at AliExpress' discretion.

알.친.소 공동구매 방장 리워드는 AliExpress의 재량에 따라 변경될 수 있습니다.

 

 

2.3.

Participant may not use coins, bonuses or other offers and coupons when proceeding a purchase via 알.친.소 Group Deal. 

참가자는 알.친.소 공동구매를 통한 구매 진행 시 코인, 보너스 등 다른 혜택 및 쿠폰을 적용할 수 없습니다. 

 

2.4.

In the case of purchase order cancellation due to the insufficient number of users specified by AliExpress for Successful 알.친.소 Purchase Group by the point of time set by AliExpress or 알.친.소 Purchase Group Host or any other participant’s violation of AliExpress-related rules(Including special provisions of the “T&Cs” and Clause 1.5), all orders for the Co-Purchase Group will be canceled. The final purchase amount which has been already settled will be automatically refunded to the Participant in the same method that was used for payment and .알.친.소 Purchase Group Reward will also be cancelled.

알.친.소 공동구매 그룹 개설을 위하여 AliExpress가 요구한 특정 인원수를 AliExpress가 정한 시간까지 충족하지 못하는 경우 및 알.친.소 공동구매 방장 또는 기타 참가자가 AliExpress 관련 규칙을( 본 약관 및 제1.5조의 특별 규정 포함) 위반할 경우 해당 공동구매 그룹의 모든 주문이 취소됩니다.참가자가 해당 구매에 사용한 결제 수단과 동일한 방법으로 이미 결제가 완료된 최종 구매액이 참가자에게 자동 환불되며 구매가 자동 취소되고 알.친.소 공동구매 방장 리워드가 취소됩니다.

 

2.5.

In the event of force majeure or change of circumstances (including but not limited to major disaster events, orders from government authorities to stop or adjust the service, severe network attacks, pandemics, or suspension due to system failures), AliExpress shall not be liable and AliExpress and/or its merchants may claim exemptions according to the provisions of relevant laws and regulations.

불가항력이나 상황의 변화(큰 재난 사건, 정부 기관의 서비스 중단 또는 조정 명령, 심각한 네트워크 공격, 전염병 또는 시스템 장애로 인한 중단을 포함하되 이에 국한되지 않음)가 발생한 경우, AliExpress는 책임지지 않으며 AliExpress 및/또는 그 상인들은 관련 법령 상 규정에 따라 면제를 주장할 수 있습니다.

 

2.6

After the payment of 알.친.소 Group Deal, a participant cannot require a refund without reason before the shipment of the product.

알.친.소 공동구매주문 결제 후 상품 발송 전까지 참여자는 단순 변심으로 인한 환불을 요구할 수 없습니다.

귀하가 본 프로그램에 참여하는 동안, 당사는 귀하의 개인 정보를 수집하고 처리할 것입니다.

4.

General provisions

일반조항

 

4.1.

In the event of any discrepancy between the provisions of these T&Cs and the marketing materials relating to the Program, the provisions of these T&Cs shall prevail in respect of the Program.

본 약관의 규정과 본 프로그램에 관련된 마케팅 자료 사이에 어떠한 불일치가 발생하는 경우, 본 약관의 규정이 본 프로그램에 대해 우선합니다.

 

4.2.

AliExpress is an online sales brokerage service provider responsible for the operation and management of AliExpress Platform where the sellers and consumers may transact goods and services, and not a seller who is the direct party of online transactions. AliExpress does not act as a seller nor a consumer, and all acts by AliExpress relating to transactions will not be deemed as any sort of representation of the sellers and/or the consumers. All obligations and responsibilities relating to the products, product information and transactions shall be borne by the sellers.

AliExpress는 판매자와 소비자가 상품 및 서비스를 거래할 수 있는 AliExpress 플랫폼의 운영 및 관리를 담당하는 온라인 판매중개 서비스 제공자이며, 온라인 거래의 직접 당사자인 판매자가 아닙니다. AliExpress는 판매자나 소비자로서 행동하지 않으며, AliExpress가 거래와 관련하여 하는 모든 행위는 판매자 및/또는 소비자의 대표로 간주되지 않습니다. 상품, 상품 정보 및거래와 관련된 모든 의무와 책임은 판매자가 부담합니다.

 

4.3.

You shall not assign all or any part of the benefits and obligations of, or its rights under these T&Cs. AliExpress shall have absolute right without obtaining consent of you to assign all its rights and obligations under these T&Cs to any other entities or persons, and by such assignment the transferee shall assume all the said rights and obligations as if it were a party hereto and AliExpress shall be full discharged of the same. Except as expressly provided in these T&Cs, a person who is not a party to these T&Cs shall not have any rights to enforce any term of these T&Cs.

귀하는 본 약관 하에 자신의 혜택, 의무 또는 권리의 전부 또는 일부를 양도할 수 없습니다. AliExpress는 귀하의 동의를 얻지않고 본 약관 하에 자신의 모든 권리와 의무를 다른주체나 개인에게 양도할 절대적인 권리를 가지며, 이러한 양도로 인해 양수인은 본 약관의 당사자인 것처럼 모든 해당 권리와 의무를 인수하게 되며 AliExpress는 모든 권리와 의무로부터 완전히 해제됩니다. 본 약관에 명시적으로 제공된 것을 제외하고, 본 약관의 당사자가 아닌 사람은 본 약관의 어떠한 조항도 집행할 권리가 없습니다.

 

4.4.

In case a dispute arises between you and AliExpress, including any dispute, controversy or claim between you and AliExpress, or those arising out of or relating to these T&Cs, or the interpretation, breach, termination or validity hereof, or any dispute regarding non-contractual obligations arising out of or relating to these T&Cs, if not resolved between You and AliExpress by amicable negotiations, shall be referred to and finally resolved by arbitration with the Hong Kong International Arbitration Centre (“HKIAC”), except as otherwise stipulated under applicable laws. For avoidance of doubt, the law of this arbitration clause shall be Hong Kong law.

귀하와 AliExpress 사이에 분쟁이 발생하는 경우, 귀하와 AliExpress 사이의 분쟁, 논쟁 또는 청구 또는 이 약관과 관련되거나이로 인해 발생하는 분쟁, 이 약관의 해석, 위반, 종료 또는 유효성 또는 이 약관과 관련하여 발생하는 비계약적 의무에 대한어떠한 분쟁도, 귀하와 AliExpress 간의 우호적인 협상으로 해결되지 않는 경우, 적용 가능한 법률에 다르게 규정된 경우를 제외하고, 홍콩 국제 중재 센터("HKIAC")에 의해 최종적으로 해결될 것입니다. 의심의 여지를 없애기 위해, 이 중재 조항의 법은 홍콩 법이 될 것입니다.

 

4.5.

If any dispute is submitted to the HKIAC for arbitration, the arbitration shall be conducted under the HKIAC Administered Arbitration Rules in force at the time of applying for arbitration as amended by this clause.The arbitration panel shall consist of one single arbitrator. Unless the Parties agree otherwise, the arbitration shall be conducted in the English language and be in Hong Kong. The arbitration may be conducted by remote means such as telephone, online via videotelephony software, and/or solely based on written submissions as specified by the party initiating the arbitration. The award of the HKIAC arbitration tribunal shall be final and binding upon all relevant parties, and the arbitration expenses shall be borne by the losing party unless otherwise determined in the award. Any party to the dispute may apply to a court of competent jurisdiction for enforcement of such award.

분쟁이 HKIAC에 중재를 위해 제출되는 경우, 중재는 이 조항에 의해 수정된 HKIAC 관리 중재 규칙에 따라 진행됩니다. 중재패널은 단일 중재인으로 구성될 것입니다. 당사자가 다르게 합의하지 않는 한, 중재는 영어로 진행되며 홍콩에서 이루어질것입니다. 중재는 전화, 비디오텔레포니 소프트웨어를 통한 온라인 또는 중재를 시작하는 당사자가 지정한 바에 따라 서면제출만을 기반으로 원격으로 진행될 수 있습니다. HKIAC 중재 판정은 모든 관련 당사자에게 최종적이며 구속력이 있으며, 중재 비용은 판정에서 달리 결정하지 않는 한 패소한 당사자가 부담할 것입니다. 분쟁의 당사자는 해당 판정의 집행을 위해관할 법원에 신청할 수 있습니다.

 

4.6.

If You initiate any legal proceedings against AliExpress or our affiliates in breach of this clause, including, if you have decided to seek dispute resolution with AliExpress, any legal proceedings disputing AliExpress’ determination which has become binding on You according to this clause, you shall hold AliExpress and our affiliates, agents, employees, directors, officers harmless and indemnified against any claim, losses, damages that may be suffered by AliExpress.

귀하가 이 조항을 위반하여 AliExpress 또는 당사의 계열사에 대해 법적 절차를 시작하는 경우, 포함하여 AliExpress와의 분쟁해결을 추구하기로 결정한 경우, 이 조항에 따라 귀하에게 구속력이 있는 AliExpress의 결정에 대한 모든 법적 절차를 포함하여, 귀하는 AliExpress와 당사의 계열사, 대리인, 직원, 이사, 임원을 모든 청구, 손실, 손해로부터 면책하고 보상해야 합니다.

 

4.7.

In any event, you may not make any claim against AliExpress and our affiliates, agents, employees, directors, officers under these T&Cs after one year from the occurrence of the matter giving rise to the claim, unless otherwise provided by applicable law. 

어떠한 경우에도, 적용 가능한 법률에 달리 규정된 경우를 제외하고, 귀하는 청구가 발생한 사건으로부터 1년 후에는 이 약관에 따라 AliExpress 및 우리의 계열사, 대리인, 직원, 이사, 임원에 대해 어떠한 청구도 할 수 없습니다.

 

4.8.

Notwithstanding the foregoing provisions, either Party may seek injunctive or other equitable relief against the other Party in any court of competent jurisdiction (e.g. including the courts of your habitual residence) prior to or during the arbitration.

 앞서 언급된 조항에도 불구하고, 어느 당사자든 중재 전이나 중재 도중 상대방에 대해 관할 법원(예: 귀하의 거주지 법원 포함)에서 금지 명령이나 기타 형평적 구제를 요구할 수 있습니다.

 

4.9.

In the event of discrepancy or inconsistency between the English version and Korean version of these T&Cs, the Korean version shall prevail.

본 약관의 영문판과 한국어판 사이에 불일치나 일관성이 있는 경우, 한국어판이 우선합니다.
